Terms and Conditions
This agreement is for your session(s) booked. And made effective for all purposes in all respects as of and hereinafter referred to as the CLIENT(S), PHOTOGRAPHER (hereafter refereed to as Toddler tales by Tuna) regarding the subject matter hereof. It overtakes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.
IMAGES & COPYRIGHTS:
All images are copyright to the PHOTOGRAPHER. The PHOTOGRAPHER has the absolute right and permission to take, use, reuse, publish, and republish photographic portraits /or drawings therefrom and any other reproductions or adaptations therefrom either complete or in part alone or in conjunction with any wording and/or drawings for all uses including publicity and/or merchandising and/or editorial purposes in all media worldwide, including online social networking sites.
The CLIENT(S) images may be used in prints, marketing and advertising materials (including social media).
Please do NOT sell, publish, reproduce (such as scan and reprints), crop, copy or alter the images in any way, without the written permission of Toddler Tales by Tuna. These photographs are to be used for personal use and non commercial use by the CLIENT(S).
AFFILIATE(S), associates, friends or relatives must obtain written permission from the PHOTOGRAPHER to acquire the photographs under creative commons attributions for other use. When publishing the photos, photographs are to be credited to the PHOTOGRAPHER by all parties involved.
MODEL RELEASE:
The CLIENTS hereby grants to TODDLER TALES BY TUNA the absolute right and permission to take, use, reuse, publish, and republish photographic portraits /or drawings therefrom and any other reproductions or adaptations therefrom either complete or in part alone or in conjunction with any wording and/or drawings for all uses including publicity and/or merchandising and/or editorial purposes in all media worldwide, including online social networking sites. No changes to the terms of this model release are accepted unless agreed in writing by the photographer or myself.
PRIVACY POLICY:
Personal information is secure and confidential. It will NOT be shared with any third party or other organizations.
LIMIT OF LIABILITY:
The PHOTOGRAPHER reserves the right to reschedule due to illness, weather or other circumstances beyond control. CLIENT(S) is/are responsible for acquiring all permits and necessary permission for all locations on which the PHOTOGRAPHER will be performing services.
The PHOTOGRAPHER is not responsible for:

CLIENT(S) choices with location, hair, wardrobe and products. Reshoot and refund will not be offered.

For any injuries inflicted upon any participating parties. – For any claims against their person or their business.
The PHOTOGRAPHER reserves the right to edit and release only those images deemed creditable as professional quality and with the Photographer’s artistic standards. No raw files will be given, final edit of digital images only as it represents the art and work of the PHOTOGRAPHER. Editing such as colour, enhancement, lighting exposure etc and basic retouching removing blemishes are included. Extensive retouching within reason such as enhancing body parts available upon request at an additional cost.
PHOTOGRAPHER’s equipment such as camera, computer and professional printer have been calibrated to offer beautiful product and images on par. However there may be a discrepancy in colour between PHOTOGRAPHER’S and CLIENTS’ monitor.

RETAINER, PAYMENT SCHEDULE & CANCELATION:
A non-refundable session fee is due to secure date and time of session. It does NOT include digital files or any additional products.
PACKAGES APPLY TO EACH INDIVIDUAL PHOTOSHOOT ONLY.
Travel fee applies as per the pricing guides shared. All travel expenses are based on the distance between the location and the studio address.
For locations outside of city limits, additional fee will be incurred above the fee mentioned in pricing guide.
By paying the session fee CLIENT(S) agree(s) to the terms and conditions.
Should CLIENT(S) cancel within 24 hours of the photo shoot or otherwise breach this Agreement, the NON-REFUNDABLE session fee shall be liquidated for damages to the PHOTOGRAPHER. And will not be refunded. Late arrival will be cut into CLIENT(S) session time and after 30 min of no show, retainer fee is forfeited and not refunded unless given notice CLIENT(S) are running late.
CLIENT(S) will have access to their fully edited gallery in 4 weeks from their picture selection. CLIENT(S) will have 20 non- business days to view their private gallery and to upgrade/order their products and digital images.
If gallery expires, failure to order within the time frame given will incur a late re opening and ordering fee. Failure to receive payment within 45 calendar days from the invoice, images will automatically be deleted.
Reshoot will be given at photographer’s discretions. Client(s) will be charged 100 percent fee for any reshoot required by client(s) unless the reshoot is required due to circumstance outside client(s) control.
DELIVERY:
Final photographs supplied by Toddler Tales by Tuna are high quality edited digital images. No raw files will be given. Final edit of digital images will be provided, as it represents the art and work of the PHOTOGRAPHER. Editing such as colour, enhancement, lighting exposure etc and basic retouching removing blemishes are included. Extensive retouching within reason such as enhancing body parts available upon request at an additional cost.
It will take between 4 weeks from the date of selection for the final digital gallery to be delivered/shared.
Prints, if ordered, will be high quality professional labs and are professionally printed. The PHOTOGRAPHER is NOT responsible for prints produced by the client(s) choice.
Prints and products will be ordered when full payment is received. It will take between 4 weeks from payment to send package to CLIENT(S).
Album proofs MUST be carefully examined before sending to print. Any mistakes once approved will incur a re ordering fee.
Products delivered to clients are from numerous well-sourced professional printer labs and suppliers. Therefore, final images display of these products may vary.
All products ordered will be carefully delivered to the CLIENT(S). The PHOTOGRAPHER is NOT responsible for the damage of portraits caused during transit and after delivery to CLIENT(S). And will NOT be responsible for damage to prints and digital files due to circumstances beyond photographer’s control; such as fading or package lost in transit if incorrect address provided.
Please examine all images in your gallery thoroughly. Any issues (i.e: missing items) must be reported within 14 calendar days of receiving the order for the issue(s) to be resolved.
Due to the nature of the photographic products (such as prints, digital images, albums, canvas and cards) no refunds will be given.
CLIENT(S) images will be kept on file by PHOTOGRAPHER for 1 year after their photo-shoot. Every effort is made to secure equipment back-up, however due to the unreliability of digital equipment data loss can occur at any time. The PHOTOGRAPHER is not liable for any loss of digital data whatsoever.
DRESS HIRE:
​Dresses from the collection is available to use for client(s) shoot.
Dresses are to be return at the end of the shoot.
Please treat the garment with the upmost of care that. Any damages, client(s) will require to to pay repair cost. If the garment is beyond repair, client(s) will be charged the replacement value of the dress
GIFT VOUCHERS:
PHOTOGRAPHER will not be held responsible for any loss or stolen gift vouchers. Gift vouchers are not non-refundable or non-transferable for cash. One gift voucher per family for year and can not be used in conjunction with any other offer.
The expiry date on your gift voucher is the date it must be registered by. Session date can be booked any time within 12 months of registration. Session dates are subject to availability. If your preferred date is not available another date will be arranged to suits CLIENT(S).
